FORMAL COMPLAINT BY THE CANADIAN VETERANS ADVOCACY
TO THE OFFICE OF THE VETERANS OMBUDSMAN
Today, this October 17, 2011 a 40 page summery of complaint with attached appendices was formerly submitted to the Office of the Veterans Ombudsman.
I have been authorized by Mike Blais the President of the Canadian Veteran’s Advocacy to submit this complaint on behalf of all injured veterans, Military and RCMP, who have been unjustly denied legitimate disability claims and or have not been granted compensation to the level of disability they deserve.
I am providing the office of the Veteran’s Ombudsman clear evidence to show that from 1997 to 2011 that the Veteran’s Review and Appeal Board have and are not respecting the decisions/direction and Case Law provided to the Board by Federal Courts and are repeatedly making the same legal/jurisdictional errors which are indicated in the Federal Court Judges decisions in the Judges own words.
I have identified 81 out of 141 Judicial Reviews involving pension applications by injured veterans, Military and RCMP from 1997 to 2011 located on the Federal Court Web site, where these 81 applicants were the Judicial Reviews were granted by the Federal Courts.
. Sixty Judicial Reviews were dismissed by the Federal Courts during this same time period.
In this analysis of these 81 Federal Judicial Reviews decisions, 16 issues were identified that the Canadian Veterans Advocacy feel that the Office of the Veterans Omubudsman need to be made aware of in light of their present investigation into the Veterans Review and Appeal Board.
This information will be available for the Contracted law firm hired by the Office of the Veterans Ombudsman to take on the task of investigating the VRAB. I am confident that these issues will be of assistance and open the door for more hard questions that need to be asked.
