Montreal Division - Resolutions Veterans Badge & AGM 2016

TO ALL DIVISION PRESIDENTS:
Please find attached hereto the letter that was forwarded on 27th February 2010 by from President, Larry Power, RCMPVA on the production or sale of a Veterans' Badge.
As well, attached hereto is a letter dated the 6th May 2010 from the Montreal Division executive committee proposing two (2) resolutions to bring before the 2010 Regina AGM on the Veterans' Badge and AGM 2016 Quebec City.
At a Board of Directors meeting on February 25th., 2010, a motion was passed that we, the RCMP Veterans' Association have not granted and will not grant, permission to any Division of the Association or any individual to produce such a badge using the RCMP Veterans' Association crest and/or name.
The BOD has looked at all the factors, i.e. liability, etc. and decided that as our current insurance policy would not cover the possible exposure due to misuse of such a badge we would not give permission for any Division to produce and/or distribute such a badge. President Power forewarded an email and letter attached on February 27, 2010, all Divisions, including Montreal and Toronto who sell similar items, were advised by this e-mail that permission was not and will not be given to any Division to produce/sell such items. It would now appear that Montreal Division's Resolution is an appeal to the membership to overrule the Board's decision.
As you know, under By-Law 111.2(3) the dead line for getting Resolutions on the AGM agenda is March 15th. and that has passed. We can't meet the requirement of notifying Divisions of Resolutions to go on AGM agenda by Jan. 15th. as required by By-Law 111.2(1)(b) and as AGM is less than one month away some Divisions may not have time to discuss the Resolution with their members and therefore may not be prepared on vote on badge issue. The Resolution on the badge will be placed on the National Council meeting agenda for June 4, 2010 and if Division delegates agree the Resolution could be carried over to AGM on June 5, 2010 for a vote, otherwise it would have to be held over to AGM 2011 in NL.

TO ALL DIVISION PRESIDENTS:
Presidents, for some time now we have been in discussion with some of our Divisions and the ROYAL CANADIAN MOUNTED POLICE concerning the use of the Force's and/or our Association Crest, which are very similar, on Identification Badges to be used by former members of the Force. The Force's position right now as I understand it is that they will not grant permission to any of our Divisions to use the Crests on such identification badges but would grant permission to our Association Nationally providing that we as an Association control the production and distribution of such badges and are prepared to accept any civil or criminal liability that occurs. We have been advised that our present liability insurance does not cover us in this situation and obtaining such coverage, if possible, may be cost prohibitive.
In view of the foregoing at a Board of Directors meeting on February 25th., 2010, a motion was passed that we, the RCMP Veterans' Association have not granted and will not grant, permission to any Division of the Association or any individual to produce such a badge using the RCMP Veterans' Association crest and/or name.
If any Division feels that this is not the right decision they have the right under our Constitution to bring the matter before an Annual General Meeting of the Association by way of a resolution to have the decision rescinded or reversed. Divisions should be aware that the Badges of the RCMP and the RCMP Veterans Association are registered and their use is protected by law and their use without written permission may put them in contravention of the RCMP Veterans' Association Constitution, the RCMP Act and/or the Criminal Code of Canada.

Re: Resolutions for 2010 Regina AGM
Montreal Division executive committee will have two (2) resolutions to bring before the 2010 Regina AGM.
First resolution :
WHEREAS the RCMP does not have the right to interfere in the sale of our veteran's badge,
WHEREAS Montreal division holds the rights and privileges since September 15th 2003, as mentioned in volume IV, page 311, of The Public Register of Arms, Flags and Badges of Canada ,
WHEREAS Montreal division presented Insp. Bird in September 2009 a sample badge with letters
RCMP-GRC removed,
WHEREAS Montreal division of the RCMP Veteran's Association known hereinafter as Montreal, will take responsibility of the sold veteran's badge and that the RCMP Veteran's Association, known hereinafter as National will not be held liable for the sold veteran's badges,
WHEREAS Montreal has been selling that souvenir veteran's badge for over nine (9) years,
WHEREAS Montreal will be the holder of the working moulds and obligations for the sale of the souvenir veteran's badge, Montreal will be sole responsible for the marketing of the said badge,
WHEREAS Montreal will be the holder of a liability insurance policy and that the National will not have any rights on sale, distribution and responsibilities
WHEREAS Montreal will abide to article 104 of the Association's Constitution and By-laws,
WHEREAS royalties will be handed over to the RCMP Foundation,
BE IT RESOLVED that Montreal is the only Division of the RCMP Veteran's Association to promote, sell and distribute the souvenir veteran's badge to any former member of the RCMP that asks for one.
Second resolution :
WHEREAS the location of AGM 2016 has not yet been determined by the RCMP Veteran’s Association,
WHEREAS Montreal division's president Gaston Desormeaux specified at AGM 2009 that Montreal Division offered to be the host of AGM 2016,
BE IT RESOLVED that Montreal Division will host AGM 2016 in Quebec City.
